WORK PERMIT FOR FOREIGNERS
The status of foreigners in the Republic of Serbia is regulated by the Law on Foreigners and the Law on Employment of Foreigners. A foreigner who aims to be employed in our country has the same rights and obligations in terms of work, employment and self-employment as domestic citizens.
Employment of a foreigner is realized under the condition that he/she has a visa for a longer stay on the basis of employment, a permit for temporary residence or permanent residence and a work permit. Most commonly, the application is submitted for a work permit on the basis of a temporary residence permit.
The documentation required for submitting an application differs from the type of requested work permit.
A work permit can be issued as:
– personal work permit;
– work permit.
Only one type of work permit can be issued for the same period of time.
A personal work permit is a work permit that enables a foreigner free employment, self-employment and exercising rights in case of unemployment, in accordance with the law. It is issued at the foreigner’s request if: 1) he has a permanent residence permit; 2) has refugee status; 3) belongs to a special category of foreigners.
A work permit is a type of work permit issued as: 1) a work permit for employment; 2) work permit for special employment cases; 3) work permit for self-employment. A foreigner with a work permit may only perform work for which he has obtained a permit.
The procedure for regulating the residence and obtaining a work permit is, usually, quite complex, primarily due to the preparation and obtaining of the necessary documentation.
